I am a small tax practitioner and a client of mine is dealing with this nightmare. They have already had to deal with nondeductibility of the contributions to their plan, but the IRS is adding the contributions to their individual income…now, on top of that, the IRS says it will be assessing this penalty even though the taxpayer's intent was only to provide life insurance policies for their employees. This client is a construction contractor and the amount of penalties the IRS is intending to assess could take them down at this point in time.
